How Akron Loans collects, uses, and sells personal information

This Privacy Policy describes how Akron Loans handles personal information, including when and how that information is sold to third parties under applicable law.

1. Introduction and scope

Akron Home Finance LLC ("Akron," "we," "our," or "us") operates Akron Loans, a loan-matching and lead-generation mobile application that connects consumers with third-party financial partners. Akron is not a lender and does not issue loans or make credit decisions.

This Policy explains what we collect, why we collect it, how we use it, and how we sell and disclose it, including to third-party lenders, marketing partners, and other buyers. Use of the App constitutes acceptance of this Policy. The App is intended for U.S. residents who are 18 years of age or older.

2. Laws and regulatory framework

Our privacy and data-sales practices are structured to align with applicable U.S. consumer finance and privacy rules, including:

GLBA (Gramm-Leach-Bliley Act): SSN, bank account data, and related financial information may be nonpublic personal financial information.
CCPA as amended by CPRA: including California definitions of "sale" and "sharing" of personal information.
FCRA (Fair Credit Reporting Act): where consumer reports and bureau-derived information are implicated.
FTC rules and guidance: including enforcement expectations for lead-generation and data-broker conduct.
CAN-SPAM and TCPA: governing email, SMS, and telemarketing communications.

Information subject to GLBA may require separate financial privacy notices and may limit, preempt, or modify certain state-law privacy rights.

3. Information we collect

3a. Information you provide directly

As part of account setup, eligibility intake, and lead generation, we collect the following information categories:

Personal identifiers: full legal name (first, middle, last), date of birth, email address, phone number (mobile and/or home), and full residential address including street, city, state, and ZIP code.
Government and identity documents: Social Security Number (SSN), driver's license number and issuing state.
Financial and employment information: bank account number (full account number), bank routing number, bank name and account type (checking / savings), employer name, employer phone number, employment status and job title, monthly or annual gross income, source of income (employment, self-employment, benefits, other), and purpose of the loan or cash advance request.

We request SSN for identity verification, lender-partner KYC requirements, and fraud prevention controls; SSN is encrypted in transit. We request bank account number and routing number for lender verification and for potential ACH disbursement or repayment setup by lender partners. We request driver's license details for identity verification, state eligibility checks, and KYC. We request employer phone information so lender partners can conduct income and employment verification.

Device identifiers, mobile operating system, app build/version, and IP address.
Usage behavior, session telemetry, and clickstream interaction data.
Approximate geolocation derived from IP or device-related signals.
Cookies, pixels, mobile SDKs, and comparable tracking technologies.

3c. Information from third parties

Identity verification and fraud-prevention vendors.
Credit bureaus and alternative data providers, including in FCRA-related contexts where applicable.
Referral, affiliate, and marketing partners that direct users to the App.

4. How we use your information

To open, maintain, and administer your user account.
To perform identity verification (KYC), fraud checks, and eligibility screening.
To convert submitted information into a lead package and match you with participating lender partners.
To sell personal information to third-party lenders, financial institutions, marketing partners, and related buyers (Section 5).
To process referral workflows and associated partner transactions.
To deliver service notices and, where lawful, marketing messages.
To conduct analytics, monitor performance, and improve app functionality.
To satisfy legal obligations, defend claims, and enforce our terms.

5. Sale and sharing of personal information

Important: Akron Home Finance LLC sells personal information as that term is defined under the CCPA/CPRA and applicable state law.

5.1 We sell your personal information

We sell personal information to third-party lenders, financial institutions, marketing partners, data aggregators, and lead buyers. Categories sold include: name, phone, email, residential address and ZIP code, SSN, driver's license number, bank account number, routing number, bank name, employer name, employer phone number, income, employment status, and stated loan purpose.

In exchange for these transfers, we may receive monetary payments, referral compensation, per-lead fees, revenue-sharing amounts, or other valuable consideration. These compensation models can affect priority routing to partners and may influence offer ranking or presentation logic.

5.2 Categories of third parties who buy or receive your data

Licensed lenders and financial institutions offering personal loans, installment products, cash advances, and lines of credit.
Insurance carriers and other financial product providers.
Debt relief and credit counseling providers.
Marketing partners distributing financial and non-financial offers.
Data brokers and aggregators that may resell personal information downstream.

After sale, recipient privacy policies and contractual terms govern downstream use. We do not control third-party post-purchase processing once data has been sold.

5.3 Your right to opt out of sale

California residents and individuals in states with applicable sale opt-out rights may direct us to stop future sales by emailing [email protected] with the subject line "Do Not Sell My Information" or by using the in-app opt-out control in Settings. We process eligible requests within 15 business days.

Opt-out requests are prospective only and do not retract information sold before the request date. We may continue sharing data where required by law or necessary to complete a service request you initiated.

6. Legal basis for processing

Consent: obtained before collection and sale; consent can be withdrawn, which may limit or disable service functionality.
Contractual necessity: to perform the matching service and related user-requested functions.
Legal obligation: compliance duties including KYC/AML, regulatory reporting, and record retention.
Legitimate business interest: fraud prevention, platform security, abuse detection, and operational stability.

7. Data retention

We retain personal information for periods reasonably necessary to provide services, satisfy compliance obligations, resolve disputes, and enforce agreements. Actual retention can vary by category and legal requirement.

When legal or regulatory requirements impose longer periods, those longer periods control.

8. Data security

Encryption in transit (TLS 1.2+) and encryption at rest, including AES-256 where applicable.
Role-based permissions and least-privilege access governance.
Ongoing monitoring, logging, and periodic security audits.
Vendor security diligence and contractual safeguards imposed on buyers and service providers.
User duty to protect login credentials and promptly report suspected unauthorized access to [email protected].

No technical control can guarantee absolute security. If a breach impacts sensitive data, we will provide legally required notice to affected users and regulators under applicable breach-notification law.

9. Your privacy rights

Subject to your state of residence and applicable law, you may have the following rights:

Know / Access: request what data we maintain and, where technically feasible, which third parties received sold information.
Deletion: request deletion, subject to legal, contractual, and compliance exceptions.
Correction: request correction of inaccurate personal information.
Portability: request delivery in a structured, machine-readable format where required.
Opt-Out of Sale: request prospective stop-sale treatment under Section 5.3.
Non-Discrimination: exercising rights will not trigger unlawful discrimination, though some features require data processing.

Submit requests to [email protected] with the subject "Privacy Request." We verify requestor identity before fulfillment. Authorized agents are accepted where state law allows. Response timelines are generally 45 days (California) and 30 days in certain other states where applicable.

10. Marketing opt-outs

Email: use the unsubscribe mechanism in each marketing email; we process within 10 business days consistent with CAN-SPAM. Transactional notices may still be sent.
SMS: reply STOP to opt out and HELP for assistance. One-time passcode and transactional messaging remains unaffected.
Push: control notification permissions through your mobile operating system settings.
Phone marketing: opt out by contacting [email protected]; TCPA prior express written consent is required for auto-dialed or prerecorded marketing calls where applicable.

Marketing opt-outs do not automatically function as sale opt-outs. To stop future sales, you must submit a separate Do Not Sell request under Section 5.3.

11. California residents (CCPA / CPRA)

If you are a California resident, the following additional rights apply under the CCPA as amended by the CPRA.

Right to Know: you may request categories and specific pieces of personal information collected, categories of sources, business purposes, and categories of third parties to whom information was sold or disclosed, including categories of buyers.

Right to Delete: you may request deletion, subject to CCPA/CPRA statutory exceptions.

Right to Correct: you may request correction of inaccurate personal information.

Right to Opt-Out of Sale/Sharing: we sell personal information under CCPA/CPRA definitions. You may opt out at [email protected] or through in-app Do Not Sell controls. We process within 15 business days.

Right to Limit Use of Sensitive Personal Information: SSN, driver's license data, and bank account data are sensitive personal information under CPRA; you may request limitations beyond permitted uses.

Right to Non-Discrimination: we will not unlawfully discriminate because you exercised CCPA/CPRA rights.

Submit requests to [email protected] with the subject "California Privacy Request." We generally respond within 45 days. One free request per 12-month period may apply. GLBA/FCRA preemption can apply to certain financial data categories.

12. Other state privacy rights

Residents of states with comprehensive privacy statutes - including Virginia (VCDPA), Colorado (CPA), Connecticut (CTDPA), Texas (TDPSA), and others - may hold similar rights depending on jurisdiction. Requests may be submitted to [email protected].

13. Do Not Track and Global Privacy Control

We do not currently respond to browser Do Not Track ("DNT") signals because no universal technical standard has been adopted. We honor Global Privacy Control (GPC) signals for California residents as an opt-out of sharing for cross-context behavioral advertising where required.

14. GLBA and FCRA notices

GLBA: SSN, bank account number, routing number, income, and employment information may constitute nonpublic personal financial information under GLBA. Where required, we may provide a separate GLBA Initial Privacy Notice that governs covered data.

FCRA: if information is furnished to or obtained from consumer reporting agencies, or if consumer reports are used, applicable FCRA rights apply. Hard credit inquiries occur only with express prior authorization.

GLBA and FCRA may preempt or narrow selected state privacy rights for information within those federal frameworks.

15. Cookies and tracking technologies

We use cookies, mobile SDKs, pixels, and device fingerprinting technologies for account authentication, fraud controls, analytics, campaign attribution, and session continuity.

Users can manage certain tracking preferences through browser controls (web) and operating-system settings (mobile). Disabling tracking components may reduce functionality or restrict portions of the service.

16. Children's privacy

The App is intended for users age 18 and older and is not directed to children under 18. We do not knowingly collect personal information from individuals under 18. If we become aware of such collection, we will take steps to delete the information promptly; notices may be directed to [email protected].

17. International users

Akron Loans is designed for U.S. users. Personal information is processed in the United States. By accessing or using the App, you consent to U.S.-based processing and transfer.

18. Policy updates

We may amend this Privacy Policy from time to time. The Effective Date at the top of this document will be revised when updates are made. If material changes occur, we may provide notice through the App, by email, or both. Continued App use after an update constitutes acceptance of the revised Policy.
